When you place an order with Mairki Ltd, you acknowledge and agree to abide by the following terms and conditions. These terms and conditions apply to all products and services offered by Mairki Ltd, whether through telesales or our website. Please note that these terms and conditions do not affect your legal rights as a customer.
1. Overarching
1.1 Once your order confirmation is received, each order becomes legally binding. The acceptance or rejection of any order is at the discretion of the company.
1.2 Please include your order confirmation number in any correspondence with us (this can be found in the delivery surname name and postcode).
1.3 Mairki Ltd reserves the right to modify or amend these terms and conditions at any time. This may include changes to payment methods, legislative requirements, delivery procedures, system capabilities, and various other topics.
1.4 Every item is accompanied by a one-year manufacturer’s warranty (as outlined in article 8).
1.5 Many items are delivered in flat-pack form and require assembly. They are designed in a way that even individuals with minimal experience can easily assemble them. We strongly advise against scheduling any tradespeople for furniture assembly until you have confirmed the safe arrival of the new goods and ensured that no items have been damaged.
1.6 It is recommended not to dispose of or dismantle any existing furniture until the delivery of the new goods, as Mairki Ltd cannot be held responsible for any unforeseen delivery issues beyond its control (as specified in article 6).
1.7 All memory foam mattresses are vacuum-packaged and rolled when purchased.
2. Cancellation
2.1 If you wish to cancel or modify your order, please contact Mairki Ltd at least 24 hours prior to the scheduled delivery.
2.2 If the products have not been dispatched, please allow 5-10 working days for the refunded amount to appear in your account from the time of cancellation.
2.3 In the event that your order has already been shipped with one of our couriers and you wish to cancel the delivery, you will be responsible for the delivery costs, which start at £29.00. This includes instances where delivery is refused at the door, unless prior arrangements have been made.
3. Exchanges and Returns
3.1 Refunds are not available.
3.1.2 Assembled items cannot be returned unless they are defective or incorrect. Items must be returned in their original packaging.
3.2 Defective or Incorrect Items: If you believe an item is defective or incorrect, we will require verification. Please note that you are responsible for providing clear photographs before initiating a return or exchange.
3.3 We will replace any incorrect or damaged items for you upon sufficient evidence.
3.3.1 Warranty will be void and replacements will not be provided if the item is damaged or misused.
3.4.1 Used mattresses are not eligible for return.
3.4.2 We will not be held liable for items that become defective due to normal wear and tear, consumer damage, negligence, or damage caused by a third party.
3.4.3 We are not responsible for any damage resulting from failure to follow assembly instructions or personal repairs or modifications.
4. Collections
4.1 All pickups will be made from the delivery address (unless otherwise agreed upon). We will determine the collection date at our discretion, but we will make every effort to accommodate your schedule.
4.2 If you will not be available for collection on the agreed-upon date, even if you have arranged for someone else to be present, please notify us via email.
4.3 It is your legal obligation to take reasonable care of the products you have received (including keeping all original packaging), and failure to do so may result in compensation claims.
5. Item Description and Specification
5.1 All photographs, drawings/illustrations, sizes, and descriptions displayed on our website or product packaging are provided for illustrative purposes.
5.1.1 We regularly update our product and service descriptions to provide the most accurate information for each item.
5.1.2 All products comply with industry standards, including mattresses that meet UK fire safety regulations.
5.2 All items will come with the specifications listed in the description.
5.2.1 While we strive to match colors and stitching to the finishes shown, there may be variations in some cases.
5.2.2 Colors may appear different based on weather conditions.
5.2.3 The mattress body may vary while the dimensions remain the same, as mentioned in 5.2.1.
5.2.4 Unless specifically ordered, all Divan beds come with a basic headboard, such as the one shown in Image 2 or 3, rather than the one depicted in the main image.
5.3 Please note that digital images on the website may appear slightly different depending on the viewing media and settings.
5.4 In rare circumstances, Mairki Ltd may provide items that slightly differ in description and specification but are otherwise identical to the ordered item. This will only occur if your item becomes unavailable for unforeseen reasons prior to shipment.
6. Orders
6.1 Once the items are delivered, it becomes your responsibility to safeguard them.
6.2 Please note that any storage charges incurred during the process of exchange or collection of items 3 and 4 will not be covered by Mairki Ltd.
6.3 Memory mattresses, being composed of polyurethane and other chemicals, may have a chemical odor when they arrive vacuum packed and rolled. As these are organic substances, it is advisable to allow them to air out for at least two days, and in some cases, up to seven days.
7. Manufacturer’s One-Year Warranty
7.1 All our items come with a FREE one-year manufacturer’s warranty. The warranty period commences upon your signing for the delivery of the items. However, there are exceptions to this policy.
7.2.1 Mairki Ltd will not be held liable for any damage caused by your failure to follow assembly instructions or any repairs or modifications made by you personally.
7.2.2 Any attempts to repair or reconstruct any components on your own.
7.2.3 Damages resulting from misuse, negligence, or actions of a third party.
7.2.4 Inability to provide appropriate proof or evidence of the extent of the damage.
7.2.5 Items that have been assembled on a hard surface.
7.3 The warranty exclusively covers manufacturing defects in the product. It does not entitle you to a complete refund within the first year. Only the specific parts or goods in question will be replaced by Mairki Ltd. No alternative options or products will be available. It will be at our discretion to determine whether to send out parts or replace the entire product. We will conduct a thorough assessment of your concerns to ensure a fair and accurate decision.
8. Force Majeure and Limitation of Liability
8.1 Mairki Ltd shall not be held accountable for any failure or delay in performing contractual obligations due to circumstances beyond our control.
8.2 Our overall liability, including negligence and other losses, is limited to the value of the order.
8.2.1 This includes, but is not limited to, loss of profits, consequential damages, expenses, lost income, third-party claims, etc.
9. GDPR and Data Protection
We strictly adhere to the Data Protection Act of 1998 as well as the General Data Protection Regulation. All your personal information is kept confidential and secure. We do not share or sell your personal information to any third parties.
